This website is owned and operated by Klein Buendel, Inc. ("KB”). Access and use of this website is provided by KB to you on condition that you accept these Terms and Conditions of Use ("Terms and Conditions”), and by accessing or using this website, you agree to these Terms and Conditions. If you do not agree to accept and abide by these Terms and Conditions, do not use this website.
KB may revise and update these Terms and Conditions at any time and without notice. You are cautioned to review the Terms and Conditions posted on the website periodically. Your continued access or use of this website after any such changes are posted will constitute your acceptance of these changes.
These Terms and Conditions apply to your use of this website, and do not alter in any way the terms or conditions of any other agreement you may have with KB. By using this website, you represent and warrant that you are over the age of 18 and are lawfully able to accept these Terms and Conditions. If you are using the website on behalf of any entity, you further represent and warrant that you are authorized to accept these Terms and Conditions on such entity's behalf, and that such entity agrees to indemnify KB for violations of these Terms and Conditions.
Use of the Website
The Real Health Photos (RHP) website and its contents (the "Content") are intended for customers of KB. You may not use this website or the Content for any purpose not related to your business with KB. You are specifically prohibited from: (a) downloading, copying, or re-transmitting any or all of the website or the Content without, or in violation of, a written license or agreement with KB; (b) using any data mining, robots or similar data gathering or extraction methods; (c) manipulating or otherwise displaying the website or the Content by using framing or similar navigational technology; (d) registering, subscribing, unsubscribing, or attempting to register, subscribe, or unsubscribe any party for any KB product or service if you are not expressly authorized by such party to do so; and (e) using the website or the Content other than for its intended purpose. Such unauthorized use may also violate applicable laws including without limitation copyright and trademark laws, the laws of privacy and publicity, and applicable communications regulations and statutes.
You may not interfere with the security of, or otherwise abuse this website or any system resources, services or networks connected to or accessible through this website. You may only use this website for lawful purposes.
Member Warranties and Responsibilities
Member warrants that he or she has provided KB with accurate, complete, and current member information. In the event that Member creates an account with the RHP website, Member agrees to correct and update that information to ensure its accuracy and completeness at all times. Entering false Member information, or failing to comply with these Terms and Conditions, may result in the revocation of the license(s) granted to the Member, as well as Member’s loss of account, services or privileges provided by KB.
Members who create a RHP account will receive a password. Each Member is entirely responsible for any and all activities conducted through his or her RHP account. Member agrees to notify KB immediately of any unauthorized use of Member’s password or account as well as of any other breach of security that may affect KB.
An individual Member may only create one RHP account. This limitation may be waived by KB if there is a pressing business or organizational reason for having more than one account. Please contact Support at 1-877-730-0852 for more information.
Upon creation of a RHP account, you may be asked to choose a Member name. Members may not select or use a Member name of another person or a name that violates any third party's trademark or other proprietary right, that is or may be illegal to use, that may cause confusion with respect to the person's identity or association with other entities, or that KB deems in its discretion to be vulgar or otherwise offensive. KB reserves the right to delete any vulgar, inappropriate or offensive Member name, or to require the deletion thereof.
Members whose accounts have been terminated by KB may not access the website without the express written permission of KB. An active Member may not knowingly allow any terminated Member to use an active Member’s account.
The number of Image download attempts is limited to three (3). You have one week (7 days) to download your purchase. For the purposes of this Agreement, a day is defined as the twenty four (24) hour period beginning at the time of your purchase. A week is defined as seven (7) consecutive days beginning on and including the date that you make your purchase.
After you download the Content, we suggest you save a copy of the downloaded file to an external drive, CD, DVD, or some other storage medium in the event you have computer problems or the downloaded file becomes damaged or corrupted. You may make one (1) copy of the Content solely for back-up purposes, and you must reproduce all proprietary notices on this single back-up copy.
You may install and use the Content in only one (1) location at a time. You may physically transfer the Content and its archives from one location to another, in which case you may use the Content at the new location instead. If you require the Content to be in more than one location (or accessible by more than one person), you must purchase and download the Content from the website for each such use.
All materials (including the organization and presentation of such material) on this website (the "Materials”) are the property of KB and may be protected by intellectual property laws including laws relating to copyrights, trade-marks, trade-names, internet domain names, and other similar rights.
Unless you have entered into a separate agreement with KB, any other use of these Materials without KB’s written permission is prohibited.
The Materials cannot be used by themselves as a product. The Materials may only be used and copied for your own purposes, provided that the Materials are not modified and that copyright and other intellectual property notices are not deleted. You may not create derivative works from or otherwise exploit the Materials in any way.
Currency of Website
KB updates the information on this website regularly. However, KB cannot guarantee or accept any responsibility or liability for the accuracy, currency or completeness of the information on this website. KB may revise, supplement or delete information, services and/or the resources contained in the website and reserves the right to make such changes without prior notification to past, current or prospective visitors.
Internet Software or Computer Viruses
Due to technical difficulties with the Internet, Internet software or transmission problems could produce inaccurate or incomplete copies of information contained on this website. Computer viruses or other destructive programs may also be inadvertently downloaded from this website.
KB shall not be responsible or liable for any software, computer viruses or other destructive, harmful or disruptive files or programs that may infect or otherwise impact your use of your computer equipment or other property on account of your access to, use of, or browsing on this website or the downloading of any of the Materials from this website. KB recommends that you install appropriate anti-virus or other protective software.
Website and Materials Provided "As Is"
This website and the materials are provided "as is" without representation, warranty or condition of any kind, either express or implied, including, but not limited to the implied representations, warranties or conditions of merchantability, or fitness for a particular purpose. KB does not represent or warrant that the RHP website or the materials will meet your requirements or that their use will be uninterrupted or error free.
Limitation of Liability
You assume all responsibility and risk for use of this website and the materials including without limitation any of the information contained therein.
Some jurisdictions do not allow for the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
You agree to indemnify and hold KB harmless against all claims or liability asserted against KB arising out of or in connection with any breach by you or anyone acting on your behalf of any of these Terms and Conditions of Use.
Notice and Procedure for Making Claims of Infringement
KB respects the copyright of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please provide KB with a written communication and KB will research your claim and respond accordingly. Please address the communication to our President and include the following information:
•An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
•Description of the copyrighted work or other intellectual property that you claim has been infringed;
•A description of where the material that you claim is infringing is located on the website;
•Your address, telephone number, and email address;
•A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
•A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

Applicable Law and Venue
Any dispute relating in any way to your use of the website or the website Content shall be submitted to confidential arbitration in Denver, Colorado, except that, to the extent you have in any manner violated or threatened to violate KB's intellectual property rights, KB may seek injunctive or other appropriate relief in any state or federal court in the State of Colorado, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this provision shall be conducted by a single arbitrator. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to the website Terms and Conditions, whether through class arbitration proceedings or otherwise.
KB’s failure to insist upon or enforce strict performance of any provision of these Terms and Conditions shall not be construed as a waiver of any provision or right.
If any provision or part thereof of these Terms and Conditions is wholly or partially unenforceable the parties or, in the event the parties are unable to agree, a court of competent jurisdiction, shall put in place thereof an enforceable provision or provisions, or part thereof, that as nearly as possible reflects the terms of the unenforceable provision or part thereof.
The parties have requested that these Terms and Conditions and all documents relating thereto be drawn up in English.

The following is for members who will be contributing images to the website. Members who will only be purchasing photographs do not need to read the following.
Contributor Membership Agreement
This website, Real Health Photos (RHP), is owned and operated by Klein Buendel, Inc. (KB). Individuals wishing to contribute photographs to RHP must become a Contributing Member. Membership warrants that he or she has provided KB and RHP with correct, thorough, and up-to-date member information. In the event that a member creates an account with RHP, the member agrees to correct and update information to ensure its accuracy and completeness at all times. By providing incorrect member information or if non-compliance is detected in relation with the RHP "Contributor Agreement,” membership licenses may be revoked. Revocation of a membership license may result in loss of account, facilities or right to contribute photographs.
How to Contribute
- •Read and accept the RHP "Contributor Agreement.”
- •Create a RHP Member Account.
- •Submit 3 photos.
- •Choose your best images for review. These images will give the RHP Review Panel an idea of your work and whether or not your photographs match the requirements of our site.
- •The RHP Review Panel will review your sample photographs.
- •If accepted, you will then be allowed to upload and provide keywords to your images. However, the RHP Review Panel reserves the right to edit tags and descriptions if needed.
PLEASE READ THE FOLLOWING "CONTRIBUTOR AGREEMENT.” YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS IS AN ABSOLUTE REQUIREMENT OF CONTRIBUTOR STATUS FOR THIS WEBSITE AND ITS PRODUCTS AND SERVICES.
RHP applies quality standards to every image uploaded to realhealthphotos.com. A review board, the RHP Review Panel, evaluates all photographs to ensure that:
•Uploaded images are original works by owner of the RHP Member Account.
•Images are professional and do not contain any technical imperfections at full size.
•Images are accompanied by permission of the people pictured and owners of private property (retained by photographer), as well as proof of copyright or trademarks.
•Images are full-size and ready to use for any application or project.
•Images do not have any negative connotations of race, ethnicity, sexual orientation, or gender.
•Images are of legal behaviors in one or more states (e.g., marijuana usage).
2. Account Information
In order to be a contributor and upload files to realhealthphoto.com, your RHP Member Account must be completed with accurate information. If information is incomplete or found to be incorrect, your RHP Member Account will be declined. If you are planning to contribute on behalf of a company or agency, there are some additional administrative steps required. RHP may terminate your account at any time, with or without reason. RHP reserves the right to terminate accounts after 2 years of inactivity. Please contact email@example.com or phone at 1-877-730-0852 for more information.
3. Image Requirements
•RHP accepts RGB and JPG files only.
•The required file size is 1600 x 1200 pixels or larger. RHP will reject photo files smaller than 1600 x 1200 pixels.
•Photo size variations will be automatically created from full resolution files uploaded.
•Files that have increased pixel dimensions to be larger than the file's native size will also be rejected.
4. Quality Standards
The overall goal of the RHP website is to feature a collection of photographs showing people who are typically under-represented on other stock photography sites. Our studies show that if the models in the photographs match the intended audience of a health message, the visual connection will make the effect of the health information stronger. Because of the lack of diversity in the photographs available, our goal is to offer diverse images of people showing healthy lifestyle behaviors. We are looking for:
•People of all races and ethnicities.
•People who are overweight or obese.
•People who are physically challenged or immobile in some way (i.e. use a cane, walker, or wheelchair).
•People of all ages.
Images that will be considered for inclusion:
•Diversity: Images representing all social and cultural backgrounds that show the importance of living a healthy lifestyle.
•Corporate shots: Illustrate the many sides of modern business addressing health related issues.
•Food and Beverages: Cuisines from around the globe that are healthy or depict a healthy lifestyle.
•Groups & Teams: People working together to achieve a health goal (i.e., group workouts, community workouts, or healthy family lifestyles).
•Holiday & Seasonal Themes: Show ways to celebrate the holidays with a healthy lifestyle (i.e., religious celebrations, local festivals and customs that promote healthy living).
•People Interacting: Healthy lifestyles that represent the diversity and multiculturalism of the world.
•Religion and Spirituality: Images showing aspects of world beliefs that promote a healthy mind and body.
•Science and Technology: Accurate and true depictions of the cutting edge of human knowledge that promotes healthy living.
•Social Issues: Powerful images portraying socio-ecological health issues that impact individuals and communities.
•Sports: Photographs depicting exercise for fun, fitness, and glory.
•Negative Health Behaviors: Images showing unhealthy behavior that can be used for educational comparisons (i.e., before/after, dos and don’ts). NOTE: These images will be limitedly accepted. We acknowledge these photos can represent "what not to do,” but do not want the site overrun with negative health behaviors.
Images that will not be considered for inclusion:
•Images of nature or the environment without people.
•Images of people not associated with health behaviors.
•Still shots of items unrelated to health.
•Suitability: Images on the RHP site need to be useful to designers. The RHP Review Panel critiques images on their suitability as stock art based on their technical and quality standards, as well as on their health-related characteristics.
•Focus: Technical standards, enforced by the RHP Review Panel, require images to be of professional quality. This requires the image’s main topic to be in focus. Creativity and artistry is highly encouraged. However, blurry and over or underexposed images will not be accepted.
•Lighting: RHP images must be well lit and properly exposed. Images with flat light, bad shadows, and poor exposure will not be accepted. Remember, we want professional quality for each image uploaded.
•Isolation: Isolating a subject against a solid (generally white or black) background can make for great RHP images. Please take time to insure that the image, though it may be isolated with a white or black background, is in focus and has proper exposure.
•Cropping & Negative Space: Cropping standards include not cutting off limbs or parts of the main focal point of the images. Each image, artistic or not, must meet the RHP Review Panel’s cropping standards. Negative space generally is not useful with stock art images unless purposefully leaving room for text in graphic design. Please take time to insure that the negative space and cropping issues are addressed before uploading.
•Over-filtering: The RHP Review Panel will not accept over-filtered, over- sharpened, and selective blurring of images.
•Borders: The RHP Review Panel will not accept images with borders or border effects applied to them. The subject or background of the image must extend to the edges of the file.
•Rotation: The files you submit to RHP must be rotated to the correct orientation so that the subject seems to be in the proper position.
•Duplicates & Series: RHP Review Panel will not accept images on the same subject repeated in a series. If you submit multiple images of one subject, please take time to ensure that each image is significantly different from the others in the series.
•Nudity: The RHP Review Panel reserves the right to reject files if the subject and composition is considered obscene, pornographic, or in any other way unsuitable for the RHP collection. This includes, but is not limited to, language or material that depicts or describes, in terms patently offensive as measured by contemporary community standards for publishing medium, sexual or excretory organs or activities. This includes patently offensive sexual or excretory references that do not rise to a level of obscenity.
•Culturally Offensive or Inappropriate Photos: The RHP Review Panel will assess images for cultural appropriateness and will not accept any photos depicting socially, culturally, or ethnically offensive photographs.
5. Legal Requirements
Trademarks, Logos & Intellectual Property: RHP cannot accept photos in which the subject has been trademarked or copyrighted. Due to copyright law and KB regulations, all logos, trademarks, company names, and product names may not be included in any photo on the RHP website. Any photographs that break this law are forbidden and will be rejected.
6. Title, Description & Keywords
Image Titles: The image title is an important part of the image file page, keywords, and search engines to help get your image noticed. You want your titles to be brief, accurate, and descriptive. If you do not provide a title with your uploaded photographs, the RHP Review Panel may reject your images or create a title if the images qualify all other requirements.
•3 main descriptions needed (in this order)
•Young, adult, or senior (if applicable)
•Woman, Man, Women, Men, Girl, Boy
•EX: lifting weights, walking, eating an apple, taking an eye exam
•If relevant to the meaning of the image
oCapitalize first word only
oLeave out articles (i.e. the, an, a)
oNo punctuation at the end
•Young woman eating apple
•Girl riding bike
•Senior men exercising in aerobics class
Description: Your image file's description should be written to provide any extra information about your image that is not relatively clear. The description should include the model’s self-identified race or ethnicity, sexual orientation (if desired), weight classification (if desired), and gender. The description must be in English and should also include descriptive information about the image content.
•Weight status (optional) + Ethnicity/Race + Age + Gender + Objective Activity Definition + Location/Shot Type or Mobility Status
oWeight Status Options: overweight
•Never "obese” unless BMI is known.
oEthnicity/Race Options: White, Black, Native American, Asian, Hispanic, Middle Eastern, Indian, Pacific Islander or other self-identified race. If more than one race, list as Mixed race
•NOTE: Hispanic is not a race. Therefore if someone is Hispanic Native American, they are not mixed race. An example of someone who is mixed race is someone who has identified as Asian and Black.
•Do NOT use "Caucasian”. Use "White”.
•Do NOT use "African American”. Use "Black”.
•Do NOT use "Indian” for Native American/American Indian.
•Do use Native American and American Indian as key word.
oAge Category Options: child (use boy or girl, don’t need to use gender next), adolescent, young adult, adult, or senior
oGender: man, woman, girl, boy
•Notice "female” and "male” are not used in the description. Gender definitions are only used in the keywords.
•Exceptions exist for babies and infants.
•Exception when using as descriptor for a profession (i.e. male doctor, female astronaut)
oObjective Activity Definition: Activity being performed in photo
•Keep activity descriptions literal to the photo.
•Do not make inferences about the photo.
•Do not add flowery descriptors (i.e., Boy eating huge, greasy burger; instead use Boy eating burger)
oMobility Status Options: immobile (only indicate if a cane, wheelchair, oxygen, or other device is present which would affect the mobility of the model subject)
oLocation/Shot Type Options: Outdoor, Indoor, Outside, Outdoor, Studio, Park, House, Kitchen, Living Room, Bedroom, Backyard, Playground, Sidewalk, any other description of the location or shot type that is necessary for users to know.
•Include mood descriptions when necessary.
oExample: "Hispanic man making sad face” Or "Happy Black young woman playing soccer”
•Capitalize first word
•Leave out articles (i.e. the, an, a)
•Do not use commas or other punctuation
•No punctuation at the end

Keywords: The most important tools for gaining attention for your photos are the keywords. Using effective keywords allows those searching for specific features and characteristics to find your images. Remember to include terms that describe the main content, action involved in the image, location, and what concepts the image might convey.
•Keep keywords applicable to the photo by adding only words that are represented in the photo.
oRestrictions to adding tags lie in the profile of the person. If a person looks White but is actually Native American and did not identify as "White,” do not tag them as such.
•Tag everything objectively.
•Tag all forms of the word.
oi.e. both "worry” and "worried”
•If the singular version of a word is contained within the plural, tag only the plural form.
oi.e. only "eyes” would be included, not "eye”
oi.e. "Strawberry” and "Strawberries” would be tagged since the plural does not include the singular form of the word.
•Tag all keywords that are in the description. Words like "in”, "and”, or "having” should not be included as tags.
oEthnicity/Race Options: White, Black, Native American, Asian, Hispanic, Middle Eastern, Indian, Pacific Islander or other self-identified race
•If someone has indicated an ethnicity that fits into a bigger category, tag both.
•EX: "Indian” is also "Asian”
oWeight Status Options: Overweight (only indicate weight status if the subject is overweight)
•Never "obese” unless BMI is known.
oAge Category Options: Child, Adolescent, Adult, or Senior
oMobility Status Options: immobile (only indicate if a cane, wheelchair, oxygen, or other device is present which would affect the mobility of the model subject), mental disability, specific conditions (down syndrome, muscular dystrophy, broken leg)
oGender: man, woman, women, men, female, male, males, females
oObjective Activity Definition: Activity being performed in photo
•Keep activity descriptions literal to the photo.
•Do not make inferences about the photo.
oSetting Type Options: Outdoor, Indoor, Outside, Outdoor, Studio, Park, House, Kitchen, Living Room, Bedroom, Backyard, Playground, Sidewalk, any other description of the location or shot type that is necessary for users to know.
•Other keywords may include: sky scraper, woods, grass, bench, urban, suburban, fall, spring, winter, summer
oMood Options: Tag moods such as happy, frustrated, angry, relaxed, sad.
oObjects: tag objects in the photo as the object name as well as the category they go in.
•Example: an apple should be tagged as "apple” and "fruit” and "nutrition”
oCategories/Libraries: Tag the category of health behavior the photo falls into that hasn’t already been covered above. Options include: physical activity, healthy eating, brain exercises, medical and hygiene, risky health behaviors, food, multiple people, single person, studio
oIndoor/Outdoor: tag both forms with suffix’s of –door and –side.
•Example: if the photo is set inside tag both "inside” and "indoor”.
oInclude other descriptors that are applicable
•i.e. "eye glasses”, "water”, "hydration”, "happiness”, "family”, "mother”
•KEEP THESE OBJECTIVE, if it is not obvious in the photo, do not tag it as such.
•If the photo is specifically depicting the model "being fit,” tag the photo with the appropriate wording. Do not tag with fitness wording if it is not an obvious feature of the photograph.
Spam: "Spamming” is when you intentionally include unfitting terms that do not have association or only a weak links to the photo content. Spamming will warrant removal of your account and membership licenses from the RHP website.
RHP Review Panel reserves the right to edit image titles, descriptions, and keywords if needed.
7. Formal Performing Arts
Formal performing arts include copyrighted and trademarked shows, plays, musicals, ballets, operas, theatre, readings, fashion shows, and other art forms that require permission to share any media related to a performance. Commercial images are prohibited by the RHP Review Panel unless there is a property release to accompany the media that specifies permission for the RHP site to host and sell the photo on this website. If a performance is nonspecific and can be understood universally, it must not contain anything that breaks copyright and trademark laws. These photos must also be free of company and product names. Keep in mind, these photos must comply with our main website theme to provide health-related photos.
Images of the following are unacceptable:
•Professional athletes or professional sports teams
•Professional sports uniforms
•Professional sporting events and sponsored events such as –
•Games, races, practices, rehearsals, promotions, public appearances, lectures, motivational speaking, and any other event that may warrant a property release
The RHP Review Panel will accept sports photography of models who have agreed to be photographed doing a sport in generic, unrecognizable brand clothing with non-logo equipment at non-property right protected locations. As with all models, a model release must be obtained and held by the contributing photographer.
9. Model Releases
The following shots must be accompanied by a model release and follow all other regulations:
•Photos that indicate an individual’s identity
•Photos in which a person can be recognized
•Shots of big crowds in which faces are recognizable
•Shots from behind
If you are unsure if a shot is acceptable, obtain a model release. The RHP Review Panel reserves all rights to request a model release at any time for any photograph uploaded to the RHP site.
All images of minors, under the age of 18, must have a model release signed by a parent or legal guardian. If a model release is not provided upon request by the RHP Review Panel, all images of that individual will be deleted from the site until further notice. The RHP Review Panel also withholds the right to terminate the contributor’s membership.
If a model release is requested, RHP does not accept digitally created or digitally signed model releases. Script fonts as signatures, e-signatures, or scanning signatures will not be accepted.
A model release template can be found on the RHP website.
10. Property Releases
In each photo that depicts a recognizable location, building, or object, a property release form should be obtained indicating permission to sell and share photographs of this particular image content. Contributors will be responsible for keeping all property releases in their possession and attest to their existence. Property releases do not need to be submitted with uploaded photographs. 11. Prohibited Uses
The language in the RHP "Purchase Agreement” discusses what a purchasing member can and cannot do with an image after they have licensed it. These rules are set to ensure the RHP website content and images are not used in a way that will harm an individual’s self-image. Images also may not be used for purposes of resale, which includes any media type that would earn money by sale through the creation of print media (i.e. postcards, mugs, t-shirts, posters, advertising, greeting cards).
12. Contributor Rights
Contributors may remove images only after images have been displayed on the RHP website for a minimum of 7 days. RHP will fulfill any license agreement set in place prior to the removal of a contributor’s images.
Exception: Images taken through a federally-funded project and uploaded to the RHP website will be allowed to preserve exclusive rights to uploaded images. It is the Contributing Member’s responsibility to check the government agency’s policy related to material sharing.
RHP Contributors will
be paid a royalty for each valid download of an image provided by said contributor. A RHP member licenses your content using purchased credits. By consenting to this "Contributor Agreement,” you are agreeing to these terms of payment compensation.
pays in US dollars. Payment will occur annually unless royalties reach $50.
Royalties over $50 will be paid quarterly within 30 days after the end of the
subsequent quarter. If you chose to terminate your account, final payments will
be made 30 days after the end of the subsequent quarter. To comply with IRS regulations, all contributors must
successfully complete a W-9 form and submit to RHP prior to submitting any
photographs for purchase on RHP. These provisions can be changed at any
time at the discretion of RHP. Contributors will
receive commission on downloaded photographs based on size downloaded.
commission is as follows:
- Small photograph: $0.25 per download
- Medium photograph: $0.75 per download
- Large photograph: $1.65 per download
-Extra-large photograph: $2.50 per download
